Considerations on the Effectiveness of the Legal Regime of Public Transparency in Spain
Abstract
The succession of political, economic and social transformations in which we are immersed implicitly implies an imminent need for public administrations and administrative law as a regulatory framework for the operation, organization and performance of public powers. The present work proposes an approximation to Law 19/2013, of December 9, of transparency, access to public information and good governance as a defining norm of the new legal regime of public transparency that, in order to be effective, needs the protection mechanisms and promotion that demands the establishment of an authentic culture based on their patterns. To this end, we also analyze the basic characteristics of administrative planning as an instrument of the so-called new public management, as well as its validity as a channel for evaluation and participation of citizens in administrative actions, in general and in the management of public interests in particular
